Overview

This website is operated by Brain on Shuffle ("we", "us", "our"). Throughout the site, "you" means the person visiting or buying from the site. By visiting our site or purchasing from us, you agree to these Terms of Service. If you do not agree, please do not use the site.

1. Using our store

You must be the age of majority in your province, state or country to place an order, or have the permission of a parent or guardian. You agree not to use our products or site for any unlawful purpose, to try to disrupt the site, or to copy or resell its content without our written permission.

2. Products and made-to-order items

Our apparel and mugs are printed on demand by third-party production partners after you place your order. We do our best to display colours and designs accurately, but your screen may show colours differently than the printed product. Sizes can vary slightly by garment. Please use the size guide. We may update, change or discontinue products at any time.

3. Prices and payment

Prices are shown in the currency displayed at checkout and may change without notice. Taxes and shipping are shown at checkout before you pay. Payment is processed securely by our payment provider. We do not store your full card details. We may refuse or cancel an order, for example because of a pricing error, suspected fraud or a product being unavailable, and we will refund you if payment was already taken.

4. Shipping, returns and refunds

Delivery is described in our Shipping Policy, and replacements and refunds are described in our Refund Policy. Because items are made to order, we do not accept returns for change of mind or wrong size or colour choice. We replace or refund items that arrive damaged, defective or incorrect when you contact us within 30 days of delivery.

5. Accuracy of information

We try to keep the information on the site accurate and current, but we do not guarantee it is complete or error-free. We may correct errors, inaccuracies or omissions at any time, including after you place an order.

6. Intellectual property

All designs, artwork, text, logos and other content on this site belong to Brain on Shuffle or are used with permission. You may not copy, reproduce, print or sell them without our written consent. Buying a product gives you the right to use the item personally. It does not give you any rights to the design itself.

7. Accounts, privacy and communications

If you create an account, you are responsible for keeping your login details safe. We handle your personal information as described in our Privacy Policy. If you sign up for emails, you can unsubscribe at any time using the link in any message.

8. Third-party links and services

Our site may link to third-party websites or use third-party services, such as our payment, shipping and production partners. We are not responsible for the content, policies or practices of third parties.

9. Disclaimer and limitation of liability

The site and products are provided "as is" and as available. To the fullest extent permitted by law, Brain on Shuffle is not liable for any indirect, incidental or consequential damages arising from your use of the site or products, and our total liability for any claim will not exceed the amount you paid for the order in question. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, except where your local consumer protection law gives you the right to bring a claim in your own location.

11. Changes to these terms

We may update these Terms of Service from time to time. The latest version is always posted on this page with its "Last updated" date. Continued use of the site after changes means you accept the updated terms.
